Induction of Conflict Minerals

剛果民主共和國(Democratic Republic of Congo, DRC)的礦產大多被非政府軍事團體或非法軍事派別所控制,並因利益衝突帶給當地嚴重的問題,包含武裝衝突、人權侵害、壓榨童工及涉及自然資源保護的問題,並且影響力已達其鄰近國家。因此,美國政府簽署了《多德-弗蘭克華爾街改革和個人消費者保護法案》 (Dodd-Frank Act)。多德-弗蘭克保護法第1502條文規定,美國公開上市的公司必須針對他們的產品中所使用的衝突金屬(錫、鉭、鎢、金),向美國證券交易委員會 (SEC) 提出文件檔揭露報告。希望透過該法案要求美國上市企業揭露所使用的金屬來源,以避免使用、進口來自剛果(Congo),或礦產來源為剛果而經由鄰近國家走私出來的衝突金屬,藉此減少人權侵害及內亂加劇的事件發生。

Many of Congo's mines are controlled by non-government militant groups and Illegal military factions that are causing serious issues in the region, such as armed conflict, the violation of human rights, pressing on the child labors, environmental impacts and have influenced surrounding countries. For this reason, U.S. Government signed the Dodd-Frank Wall Street Reform and Consumer Protection Act (the “Dodd-Frank Act”) in July 2010,. Section 1502 of the Dodd-Frank Act requires all US publicly traded companies to file disclosures and reports with the U.S. Securities and Exchange Commission (SEC) related to the use of Conflict Minerals (tin, tantalum, tungsten and gold) in their products, expected through this Act to request publicly traded companies in United States to reduce violation of human rights through disclosure of the origin of metals in order to avoid either using and importing “conflict metals” from Congo or mineral sources from Congo which illegally taxed on trade routes through surrounding countries.

復揚科技尊重國際人權,因此我們將持續關注此事件並致力詳實調查供應鏈,確保金(Au)、鉭(Ta)、鎢(W)、錫(Sn)這類金屬來源並非由剛果民主共和國(DRC)衝突區域之礦區開採,並邀請我們的供應商夥伴一同調查產品中所使用的金屬來源,善盡企業公民的責任。

復揚將只從經過獨立第三方驗證的冶煉廠/精煉廠進行採購(特殊情況下,僅由已被特定客戶指定的機構或組織認證為有效的“無衝突”的冶煉廠/精煉廠進行採購);遵循經合組織盡職調查指南的指引,對礦產的來源和保管過程進行盡職調查,明確要求供應商所提供的礦產不直接或間接地使嚴重侵犯人權的武裝團體受益。鼓勵供應商遵循OECD指南,詳實的公開使用在產品以及零組件中的礦產來源;要求供應商引用衝突礦產報告範本(CMRT)來提供供應鏈中所用到之金(Au)、鉭(Ta)、鎢(W)、錫(Sn)的冶煉廠訊息報告;同時,復揚不禁止來自DRC或毗鄰國的衝突礦產。

FuYang Technology will keep on concerning this issue and will take due diligence within our supply chain to assure the metals sources of gold (Au), tantalum (Ta), tungsten (W), tin (Sn) are not derived from mining in conflict region of the Democratic Republic of Congo (DRC). We will also invite our supply chain together to investigate metal sources of products and do our best to avoid using conflict minerals, and endeavor to fulfill responsibilities of a corporate citizen.

FuYang will only purchase from smelters / refineries verified by independent third parties (in special cases, commit to source only from smelters/ refineries that have been validly certified as “conflict-free” by an organization or program that has been designated by specific customers). FuYang will follow the guidance of the OECD due diligence guide to make due diligence on the source and storage of the mineral resources, and make it clear that the mineral resources provided by the supplier are not directly or indirectly benefited by the armed groups of serious human rights violations. FuYang will encourage suppliers to follow the OECD guide, fully and openly use the mineral sources in the products and the parts, and require suppliers to quote the CMRT to provide the smelter information report of gold (Au), tantalum (Ta), tungsten (W), tin (Sn) used in the supplier chain. Meanwhile, FuYang will commit not ban all minerals from the DRC or an adjoining country.
